VG Bild-Kunst is the German collecting society for the administration of copyrights of visual artists, photographers and other creators of visual art. It operates within the scope of the provisions of the German Law on the Administration of Copyright and Neighbouring Rights dated 9 September 1965. Besides authors from the Federal Republic of Germany, VG Bild-Kunst also represents international authors through reciprocal agreements with collecting societies in other countries. All uses of works of visual art and photography, whose authors are represented by VG Bild-Kunst, are subject to the prior consent of VG Bild-Kunst. The Bonn office grants permission for reproduction and attends to invoicing. Exploitation fees are based on the commercial significance of the reproduction. They are fixed in the tariffs drawn up for the specific use in question or in separate agreements.
The tariffs in force were prepared by VG Bild-Kunst in accordance with Art. 13 (2) of the German Copyright Administration Act (UrhWahrnG) and published in the version of the Bundesanzeiger [Federal Gazette] available on the Internet. The tariffs are binding only for rights granted by VG Bild-Kunst. The rights in question are reproduction and distribution rights, which have already been assigned by the authors. As a general rule, they are not binding for agreements concluded directly between authors and/or other rightholders and the user.
The exploitation rights granted by VG Bild-Kunst do not cover any services such as those offered by an agency like for example furnishing photographic or pictorial copy material or providing copy material for printing. If the user is granted exploitation rights by VG Bild-Kunst, such rights are in all cases only non-exclusive exploitation rights for the territory of the Federal Republic of Germany. Users are not entitled to re-assign the exploitation rights.
